नई दिल्ली। देश भर में छोटे बच्चे जिनको कानूनी भाषा में जुवेनाइल कहते है, के साथ होने वाले अपराध की पैरवी को लेकर सुप्रीम कोर्ट ने कड़ा रुख अपनाया है। चीफ जस्टिस जे एस खेर जी देश भर की हाई कोर्ट्स को जुवेनाइल के केसों की पैरवी के लिए विशेष पब्लिक प्रोसिक्यूटर नियुक्त करने का आदेश दिया है। खास बात यह कि इस स्वतंत्र पद पर वकील की नियुक्ति खुद हाइकोर्ट करेगी।
श्री खेर ने यह आदेश एडवोकेट गौरव कुमार बंसल की याचिका पर जारी किया। बंसल ने याचिका दायर कर मुद्दा उठाया था कि राज्य सरकारें पॉक्सो एक्ट 2012 के केसों की सरकारी स्तरीय पैरवी सही ढंग से नहीं करवा रही जिससे जहां ट्रायल लंबा खिंच रहा है, वहीं पड़ताड़ना के शिकार बच्चे को इंसाफ की राह देखनी पड़ रही है। इसके अलावा यह मांग भी की थी;

Issue Writ of  Mandamus against the Respondents to appoint Independent Public Prosecutors as defined under Section 32 of the Protection of Children from Sexual Offences act- 2012.

Issue Writ of Mandamus against the Respondents to convert the Special Courts constituted under Section 28 of the POCSO Act into “Exclusive Court” for hearing cases registered under POCSO ACT – 2012 only.

Issue Writ of Mandamus against the Respondents to provide all the necessary infrastructure in Courts so that Child friendly atmosphere can be provided to the Innocent Child victims.

Issue appropriate Writ/Order/Direction to the Respondents to implement the provisions of the Protection of Children from Sexual Offences Act-2012.
सुनवाई में माननीय मुख्य न्यायाधीश ने महसूस किया कि सेक्शन 36 के तहत बहुत सी कमियां है जिनको विशेष पब्लिक प्रोसिक्यूटर नियुक्त करके दूर किया जा सकता है।
